A group has filed a new lawsuit today attempting to prevent snowmaking with reclaimed wastewater at Arizona Snowbowl.
Nine individuals and the group Save the Peaks Coalition are asking the U.S. District Court in Arizona to reconsider whether snow made from reclaimed water is safe for skiers or the surrounding environment.
This question was taken up repeatedly by various courts as the case was argued to the U.S. Supreme Court.
The Supreme Court declined to hear the case in June, which cleared the way for snowmaking and other construction and ski-trail building at Arizona Snowbowl following two conflicting decisions at the 9th U.S. Circuit Court of Appeals.
Construction has not happened to date.
For the most part, the courts heard the last case argued on religious grounds.
This legal case returns to assertions of environmental damage.
As part of the lawsuit, these plaintiffs have sought an injunction to prevent construction at Arizona Snowbowl.
The plaintiffs suing the U.S. Forest Service are the Save the Peaks Coalition, Kristin Huisinga, Clayson Benally, Sylvan Grey, Don Fanning, Jeneda Benally, Frederica Hall, Berta Benally, Rachel Tso and Lisa Tso.
